What is this?

Diyar Online is a mobile game (iPhone, iPad and Android) that is still in development. The game is operated by Minata Entertainment, LLC ("we"), a limited liability company organized in Delaware (USA); this site is published by NOVENTRA STUDIOS, LLC (Itemgold). In these terms "the site" means diyar.itemgold.com and the other addresses the game and the mobile apps use to provide the service. By using the site and the game you accept these terms. The company that publishes the web edition and this site (diyar.itemgold.com):

Noventra is the publisher of the web edition and of this site only; it is responsible, in its own name, for the technical records made when it serves the site and for its own services such as the Itemgold membership. The publisher and seller of the mobile apps (App Store, Google Play), the operator of the game service and the only controller of the account and game data is Minata Entertainment, LLC.

When you download and play the app through the App Store or Google Play, that store's own terms and policies apply as well. These terms are between you and Minata Entertainment, LLC only; Apple and Google are not a party to them. Minata Entertainment, LLC is responsible for the game's content, maintenance and support. As the publisher of this site Noventra is not a party to these terms; it is responsible, under its own terms, for serving the site and for Itemgold's own services (such as the Itemgold membership).

Early access: provided as is

• Playing the game is free and it is provided "as is". There may be interruptions, bugs and balance changes.
• During development the world, characters, items, houses and villages may be reset or changed. Progress in the game is not guaranteed. Your Diamonds balance and the rights you bought with Diamonds are not affected: they are kept on your account, not on your character, and a reset of the world or of characters does not delete them. If a change makes something you bought with Diamonds unusable, we adapt the product to the new setup or write its Diamonds price back to your account.
• The in-game economy includes an optional Diamonds store: see The Diamonds store. Power is not sold: details in the Diamonds Terms.

Your account, age and character

• Guest or account. You can play as a guest without an account; an ID stored on your device opens your character. Protecting the ID is your responsibility: do not share it and think before clearing the app's data or removing the app; a lost ID cannot be recovered. A guest character cannot use the Diamonds store.
• Account. If you wish, you create an account with an email and a password or with Sign in with Apple / Sign in with Google; an account is needed for the store, the premium Season Path and continuing across devices. You must give a correct email address that is yours, keep your password safe and not share it with anyone. On an account you created with Apple or Google there is no password until you add one; you sign in with that provider account (details). You are responsible for everything done under your account; if you notice unauthorized use, write to us at once. An account belongs to one person; selling, buying or transferring accounts or characters is forbidden.
• Age. To create an account and play you must be at least 13 years old; if the country you live in sets a higher age, that age applies. If you are a minor, a parent's or guardian's permission may be needed for in-app purchases; purchases are subject to the age and family settings of the App Store and Google Play.
• Your character name must be 3–16 characters long and must not bother others. Inappropriate names may be changed or the character removed. There is one connection per account; if you open the same character a second time the old connection closes.
• You can ask for your account to be deleted at any time; details in the Privacy Policy.

The Diamonds store

• Diamonds are the in-game virtual currency; they are tied to the account, cannot be transferred, cannot be converted to cash or in-game gold, and the balance does not expire. The full rules: Diamonds Terms.
• Diamonds are bought only inside the app, through the App Store or Google Play; the store takes the payment and the purchase is subject to the store's terms. Refunds go through the store's own refund process (details).
• Refunds and payment disputes: the Diamonds of a payment that was refunded, or that is disputed, are deducted from your account; if the balance is not enough, your products are cancelled and the account is restricted; if a dispute is lost, the account stays restricted until the review ends, and a repeat brings a store ban (details). If you have a legitimate complaint, write to us first.
• Using stolen or unauthorized payment methods is forbidden.

Fair play

The server calculates hits, damage, loot, deaths, trades, gathering and store results itself. The following are forbidden and can lead to your character being deleted and your account being restricted or banned:

• Cheats, bots, automation (except the game's own Auto Hunt), modifying the client or network traffic;
• Using bugs or exploits to duplicate items, gold, Diamonds or progress; abusing a hole you found instead of reporting it;
• Overloading, attacking or scanning the server;
• Buying or selling accounts, Diamonds or products;
• Inflating rankings, season points or Winter contribution with any of these methods.

Conduct and PvP

Attacking another player (PK) is a game mechanic and is limited by the game's rules (PK mode, outlaw status, newbie protection, corpse looting). These rules are no excuse for harassment, hate speech, threats, sharing personal information or spam; those are forbidden in chat. Chat runs through an automatic profanity filter and you can block players.

Warnings, restrictions and bans

For a breach of these terms, one or more of the following may be applied, in order of the severity of the breach: a warning; restricting chat; temporarily stopping spending and purchases; closing store access; temporarily suspending the account; permanently banning the account. For serious breaches (fraud, payment abuse, gains made by cheating) no warning may be given; the gains and products concerned may be cancelled. When we apply a restriction we tell you the reason and how to appeal; administrator actions are written with their reason to a log that cannot be altered. To appeal: support@playdiyar.com. A banned account cannot be signed in to and Diamonds cannot be spent; while an appeal is being decided the balance and rights are frozen. If the ban is lifted they open again as they were; if the ban becomes final the remaining Diamonds become void and are not refunded (Diamonds Terms). This does not affect refund rights that the store or the law gives you.

Intellectual property

The Diyar Online name, logo, universe, artwork and all game content (the code, the pixel art generated by code, the texts, and the map and sound data) belong to Minata Entertainment, LLC and cannot be copied or distributed without permission. Content creators may use game footage in videos and streams; for commercial use, ask for permission: legal@playdiyar.com. The cosmetics and rights you buy give you a license to use them in the game; they are not a transfer of ownership or copyright.

Font license

The site and the game use a single pixel font called Pixelart UI: a derivative of Jersey 10 (Soft Type Project, SIL Open Font License 1.1) extended with hand-drawn symbols for the game. License text: /fonts/OFL.txt. The font is not sold on its own; the license terms apply.

Liability

To the extent the law allows, no liability is accepted for damage arising from service interruptions, data loss or bugs of the early version. Consumer rights that cannot be waived under the rules of the country you live in remain yours. The game's internal balance and content may change without notice.

Governing law

These terms and any dispute arising from them are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws rules. For questions and legal notices: legal@playdiyar.com.

Changes

These terms are updated as the game develops; the date at the top shows the last change. For important changes you will be asked to accept the new version of the terms again before buying. How your data is processed is in the Privacy Policy.
